Derecho a la vida la salud y la seguridad social de beneficiaria del regimen subsidiado a quien le diagnosticaron cancer de mama enfermedad terminal catalogada como catastrófica y de alto costo y no obstante las peticiones formuladas para la asignación de una ars que le brinde el tratamiento integral de la enfermedad y le exonere del pago de cuotas de recuperación la entidad le niega la peticion aduciendo que posee los medios economicos para sufragar este gasto.

Solicita se ordene la asignación de una ars que la atienda.

Hecho superado por cuanto detectada la nulidad la sala se abstuvo de revisar el fallo y ordeno remitir el expediente al juez de instancia para de ser necesario rehiciera la actuacion.

El juez concedio el amparo solicitado.

PRIMERO. Levantar la suspensión de términos decretada en este asunto.
SEGUNDO. CONFIRMAR el fallo proferido por el Juzgado Civil del Circuito de Roldanillo -Valle-, el trece (13) de julio de 2005, dentro de la acción de tutela instaurada por María Elena Romero Latorre contra la Secretaría Municipal de Salud de La Unión -Valle-, mediante el cual se concedió la tutela de los derechos fundamentales invocados.
TERCERO. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
