Primero. REVOCAR el fallo proferido por el Juzgado
Primero. Penal Municipal de Girardot, el 30 de septiembre de 1999, al resolver sobre la acción de tutela incoada por Rafael Sánchez Viuche contra el Municipio de Girardot, representado por el señor Adolfo Moncaleano Garzón y, en consecuencia, CONCEDER la tutela de los derechos fundamentales a la vida, al trabajo y a la dignidad.
Segundo. ORDENAR al Municipio de Girardot representado por Adolfo Moncaleano Garzón que, en el término de las cuarenta y ocho (48) horas siguientes a la notificación de esta providencia, proceda a cancelar los salarios adeudados del actor. Si la administración alegare no contar con la partida presupuestal suficiente para quedar totalmente al día por el aludido concepto, deberá probarlo ante el juez de instancia, y en ese evento el plazo concedido se otorga para que inicie las gestiones presupuestales pertinentes, informando de todo al juzgado de instancia, bajo el apremio de las sanciones legales por desacato.
Tercero. Por Secretaria, LÍBRESE la comunicación de que trata el artículo 36 del Decreto 2591 de 1991.
