- Primero. REVOCAR el fallo de 28 de junio de 2001 del Juez
- Quinto. Civil del Circuito de Popayan y el fallo de 16 de agosto de 2001 del Tribunal Superior del Distrito Judicial - Sala Civil Laboral- de Popayan.
- Segundo. TUTELAR los derechos de acceso a la justicia, debido proceso y a la defensa del ingeniero Luis Hector Solarte Solarte.
- Tercero. ORDENAR al Alcalde de Popayan que en el termino de 48 horas contados a partir de la notificacion del presente fallo, cumpla con la clausula compromisoria y en consecuencia fije el lugar de funcionamiento del Tribunal de Arbitramento pactado en el contrato CCOP-01-93.
- Cuarto. Por Secretaria General librese las comunicaciones previstas en el articulo 36 del Decreto 2591 de 1991.
