CONFIRMAR, por las razones contenidas en este fallo, la sentencia proferida por la Sala de Casación Penal de la Corte Suprema de Justicia el veintinueve (29) de abril de 2008, dentro de la acción de tutela invocada por el señor Ismael Cubillos León contra los Juzgados 19 Penal Municipal y 42 Penal del Circuito, con funciones de conocimiento de Bogotá D.C., que confirmó la sentencia proferida por la Sala penal del Tribunal Superior del Distrito Judicial de Bogotá.
- Segundo. Por Secretaría líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1.991.
