- Primero. REVOCAR el fallo proferido en marzo 27 de 2008 por el Juzgado
- Quinto. Civil del Circuito de Cali, que habia revocado la tutela concedida a la senora Alba Lucia Sossa Aguirre en febrero 11 del mismo ano, por el Juzgado 4deg Civil Municipal de dicha ciudad. En su lugar, se dispone TUTELAR los derechos de la mencionada senora a la seguridad social, a la salud y a la dignidad humana.
- Segundo. En consecuencia, ORDENASE al representante legal de CAPRECOM ARS, seccional Valle del Cauca, o quien haga sus veces, que en el termino de cuarenta y ocho (48) horas contadas a partir de la notificacion de este fallo, si no lo ha hecho, proceda a realizar una junta de especialistas en lo atinente a la obesidad morbida que padece Alba Lucia Sossa Aguirre y, si asi se determina cientificamente, previa cabal informacion clara y consentimiento conciente de la actora, autorice los procedimientos para atender la obesidad morbida que padece y, si fuere del caso, le realice el "bypass gastrico por laparoscopia", con la debida continuacion del tratamiento integral que requiera.
- Tercero. Por Secretaria General, LIBRESE la comunicacion a que se refiere el articulo 36 del Decreto 2591 de 1991.
