- PRIMERO. REVOCAR la Sentencia proferida por el Juzgado 36 Penal Municipal de Cali, por las razones expuestas en esta sentencia.
- SEGUNDO. DENEGAR la tutela solicitada por el senor Julio Enrique Torres Bustamante, en representacion de su hijo Julian Humberto Torres Salazar, por la vulneracion de los derechos de los ninos y el derecho a la salud, por las razones expuestas en esta sentencia.
- TERCERO. Como consecuencia del numeral anterior, el joven Julian Humberto Torres Salazar debe reintegrarse al Batallon de Policia Militar No. 3, en el cual se encontraba en el momento del cumplimiento del fallo que le concedia la tutela, para de esta forma prestar su servicio militar obligatorio, teniendo en cuenta sus aptitudes fisicas y psicologicas.
- CUARTO. COMUNICAR a traves de la Secretaria General de la Corte Constitucional el contenido de la sentencia al Juzgado 36 Penal Municipal de Cali, al Ministerio de Defensa Nacional, al Batallon de Policia Militar No. 3, al Batallon de Policia Militar No. 13, al Defensor del Pueblo y al peticionario de la presente tutela.
