Primero. CONFIRMAR, pero por las razones aquí expuestas, la sentencia del H. Consejo de Estado, Sección Quinta, de fecha 15 de agosto de 1996 que a su vez confirmó la decisión judicial del Tribunal Contencioso Administrativo del Cauca de fecha 17 de julio de 1996. Además, se ordena a este último Tribunal que haga conocer el contenido de esta providencia al propietario de Metálicas La Esmeralda, para que adopte las medidas de protección contra el ruido a que ella se refiere.
Segundo. ORDENAR que por Secretaría General de esta Corporación se comunique el contenido de estas providencias, en la forma y para los efectos previstos en el artículo 36 del Decreto 2591 de 1991.
