- Primero. Declarar EXEQUIBLE el artículo 158 de la ley 200 de 1995 (Código Disciplinario Único), advirtiendo que en su aplicación el superior no podrá, en ningún caso, agravar la pena impuesta al apelante único, haya o no una pluralidad de disciplinados.
- Segundo. Declarar EXEQUIBLE el inciso 3o. del artículo 103 de la ley 200 de 1995 (Código Disciplinario Único), excepto la palabra "no" y la expresión ", excepto que el objeto de la apelación sea diferente", que se declaran INEXEQUIBLES.
