Conflicto de competencia suscitado entre el Juzgado Octavo Penal Municipal con Funciones de Control de Garantías de Ibagué y el Juzgado Tercero Laboral del Circuito de la misma ciudad.
Teniendo en cuenta que la acción de tutela fue interpuesta contra un particular que ejerce la función periodística a través de la publicación de reportajes en un medio de comunicación virtual y en sus redes sociales, considera la Corte que, de acuerdo a lo dispuesto en el artículo 37 del Decreto 2591, el recurso de amparo es competencia de los jueces con categoría de circuito.
Se dirime el asunto con la remisión del expediente al Juzgado Tercero Laboral del Circuito de Ibagué, para que de manera inmediata tramite y adopte la decisión de fondo a que haya lugar.
