El magistrado José Fernando Reyes Cuartas manifestó estar impedido fallar el proceso de la referencia, por estar incurso en la causal de tener interés en la actuación procesal, en la medida en que la autoridad judicial accionada debe decidir sobre una demanda de nulidad en la cual se cuestionó su elección como presidente de la Corte Constitucional para el período 2024-2025.
Consideró la Sala que en el presente caso no hay un interés directo, personal y actual por parte del doctor Reyes que justifique apartarlo del conocimiento del caso objeto de revisión y, por ello, decidió declara INFUNDADO el impedimento formulado.
