Se remitió el expediente de la referencia al Juzgado competente para realice el trámite de tutela instaurado por la accionante contra la Nación - Presidencia de la República, el Ministerio de Hacienda y Crédito Público, el Ministerio de Trabajo y Seguridad Social y el Director del Servicio Nacional de Aprendizaje, Sena.

Para la Corte es claro que el Presidente de la República carece de competencia para introducir modificaciones al Art. 37 del Decreto 2591 de 1991, como las que efectivamente introdujo a esa norma legal mediante el referido artículo, pues ello corresponde al Congreso de la República mediante ley.
