Mediante el presente auto se puso en conocimiento del demandado la acción de nulidad saneable, debido a la falta de notificación del inicio de la tutela, en consideración la Corte buscando garantizar el debido proceso ordenó al Juzgado respectivo seguir con el trámite correspondiente.
En consecuencia, devolvió el expediente al mencionado Juzgado para que agotara el procedimiento fuere o no alegada la nulidad, posterior a esto la Corte realizará su eventual revisión.

- Primero. Poner en conocimiento de la sociedad Carbones del Carare Ltda., por intermedio del Juzgado Promiscuo Municipal de Landazuri (Santander), la nulidad saneable derivada de no habersele notificado la iniciacion de la presente accion de tutela, advirtiendole que si la alega dentro de los tres (3) dias siguientes a la notificacion de este auto, se declarara la nulidad de lo actuado a partir del auto admisorio y se tramitara nuevamente la tutela, con plena observancia de las garantias propias del debido proceso. Si no la alega, la nulidad quedara saneada y el proceso continuara su curso.
- Segundo. Agotado el procedimiento al que se refiere el numeral anterior, fuere o no alegada la nulidad, devuelvase el expediente a esta Sala para su revision.
