Se revoca el fallo proferido por el Tribunal Administrativo y ordena al Juez del conocimiento que proceda a integrar el contradictorio para configurar la legitimación en la causa de la parte demandada.
La Corte expone que en la acción de tutela no pueden expedirse fallos inhibitorios y señala que mientras no se vincule debidamente a la parte demandada no es posible proferir sentencia de mérito, estimatoria o desestimatoria de las pretensiones de la demanda.
