Decretó la nulidad de todo lo actuado en la acción de tutela de la referencia y ordenó devolver el expediente al Tribunal Administrativo de Cundinamarca, por considerar se incurrió en una causal de nulidad procesal, toda vez, que el expediente por desacato fue remitido a la Corte Constitucional quien carece de competencia para ello.
La Corporación señala que se desconoció la normatividad establecida en el Art. 52 del Decreto 2591 de 1991, que contempla que el incidente de desacato de tutela deberá ser propuesto ante el juez que profirió la respectiva orden, quien avocará su conocimiento y trámite, con las garantías efectivas del debido proceso, e impondrá, si hay lugar para ello, la sanción respectiva, la cual podrá ser apelada ante el superior jerárquico, quien la confirmará o rechazará, según el caso.
