No se declaró la nulidad de la Sentencia SU.805/03 proferida por esta Corporación, toda vez que no se vulneró el debido proceso y a la igualdad, pues, la fiduciaria de la referencia, como querellante legítimo, no instauró en su momento el proceso policivo de lanzamiento.
Dejó que en su lugar lo haga un tercero no legitimado para ello.
No obstante, pretende que se anule el fallo de tutela que impidió el lanzamiento ante la ilegitimidad del querellante.
Luego, lo que pretende es que se anule la sentencia de unificación para evitar los efectos de su propia omisión.
Y, desde luego, esa no es la teleología de esa institución excepcional que es la nulidad de los fallos proferidos por esta Corporación.
Contra esta decisión no procede recurso alguno.
