Art. 217. Si del certificado resultare que la finca está gravada, el Juez ordenará de oficio que se cite personalmente á los acreedores que tengan constituida hipoteca en dicha finca, emplazándolos para que dentro de un término que prudencialmente fije, comparezcan á hacer uso de su derecho en juicio de tercería.
