Decisión. Demostrada la violación de las garantías constitucionales o leg ales, el juez inmediatamente ordenará la libertad de la persona capturada, por auto interlocutorio contra el cual no procede recurso alguno. Si se niega la petición la decisión podrá ser impugnada. En ningún caso el trámite y la decisión sobre el hábeas corpus pueden exceder de treinta y seis (36) horas.
