ARTICULO 352 . A quién se recibe indagatoria . El funcionario judicial recibirá indagatoria a quien en virtud de antecedentes y circunstancias consignadas en la actuación, o por haber sido sorprendido en flagrante hecho punible, considere autor, o partícipe, de la infracción penal. En los procesos de competencia de los jueces regionales, conforme a las necesidades de la investigación y cuando se trate de pluralidad de imputados, el fiscal podrá diferir la vinculación de algunos al momento de la instrucción que considere más oportuno de acuerdo con el desarrollo de la misma. Cuando considere pertinente proceder a la vinculación, librará orden de captura.
