- Primero. REVOCAR los fallos proferidos por la Sección Cuarta del Tribunal Administrativo de Cundinamarca y por la Sección Tercera de la Sala de lo Contencioso Administrativo del Consejo de Estado, mediante las cuales negaron la tutela. En su lugar, se CONCEDE la protección del derecho al debido proceso.
- En consecuencia, se deja sin efecto lo actuado a partir del auto del 5 de noviembre de 1998, por medio del cual la Sala Jurisdiccional Disciplinaria del Consejo Superior de la Judicatura negó la nulidad solicitada por Juan de Dios Villamil Velandia, con el fin de que se devuelva el expediente a la Sala Jurisdiccional Disciplinaria del Consejo Seccional de la Judicatura de Cundinamarca para que dicha corporación resuelva lo relativo a la petición de nulidad.
- Segundo. DESE cumplimiento a lo previsto en el artículo 36 del Decreto 2591 de 1991.
