El actor se encuentra recluido en la cárcel de Jericó (Antioquia) y su esposa también está privada de la libertad, pero en la institución carcelaria el Pedregal.
Se presenta la acción de tutela para solicitar el traslado de la cónyuge con el ánimo de garantizar la efectividad de sus derechos a la integridad afectiva, marital e íntima.
La Sala considera que el actor cuenta con un mecanismo administrativo idóneo y eficaz para la protección de sus derechos fundamentales que debe agotar antes de acudir a la acción de tutela.
Así mismo, considera que existen circunstancias y actuaciones que deben ser analizadas y coordinadas exclusivamente por el INPEC y que en tal medida, le impiden dar al juez constitucional una orden sobre las mismas.
Adicionalmente, corrobora que no existe la vulneración alegada frente al derecho de la visita íntima, pues el actor no elevó ninguna solicitud en este sentido.
Se confirma la decisión de instancia que declaró la improcedencia de la acción de tutela impetrada.

- PRIMERO. CONFIRMAR la providencia dictada el 29 de mayo de 2012 por el Juzgado Veinticuatro Penal del Circuito con Funciones de Conocimiento de Medellín, que declaró improcedente la acción de tutela instaurada por Luis Eduardo Arbeláez Henao, contra el Complejo Carcelario y Penitenciario "El Pedregal" del INPEC.
- SEGUNDO. LÍBRESE por Secretaría General la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
