- PRIMERO. REVOCAR las decisiones objeto de revisión y en su lugar CONCEDER la tutela por las razones indicadas en la parte motiva de este fallo.
- SEGUNDO. ORDENAR al alcalde de San Benito Abad que en el término de un mes, contado a partir de la notificación del presente fallo, efectúe todas las diligencias necesarias para pagarle a Eligio Andrés Severiche los salarios debidos y PREVENIR para que en adelante no se vuelva a incurrir en mora.
- TERCERO. PREVENIR al alcalde de San Benito Abad para que no tome represalias contra Eligio Andrés Severiche, en cuanto considera dicho alcalde que interponer la tutela es temeridad y causa daño y desorganización en la alcaldía.
- CUARTO. Por Secretaría líbrense las comunicaciones previstas en el artículo 36 del decreto 2591 de 1991.
