Trabajo, debido proceso administrativo.
La accionante comenta que su representada laboró para la entidad accionada como secretaria pese a encontrarse vinculada a la entidad como auxiliar de servicios generales grado 4, pero debido a que el Defensor del Pueblo seccional Sucre expidió un oficio en que le informaba a su representada que no podía desempeñar labores diferentes a las funciones propias del cargo que ostenta, paso de desarrollar funciones administrativas a realizar oficios varios de aseo a las instalaciones y demás, esto la ha afectado gravemente en su integridad física y psicológica, por lo tanto solicita nombrar a su representada en un cargo de auxiliar administrativo.
La Sala encuentra que durante el proceso fue nombrada auxiliar administrativo en esta entidad, por lo tanto se esta frente a un hecho superado y por lo tanto se decide confirmar los fallos revisados, por carencia actual de objeto.

- Primero. CONFIRMAR por carencia actual de objeto, el fallo de la Corte Suprema de Justicia, Sala de Casacion Penal, Sala Segunda de Decision de Tutelas, proferido el 7 de mayo de 2009, que a su vez confirmo el dictado el 3 de marzo de 2009 por el Tribunal Superior de Sincelejo, Sala Penal.
- Segundo. Por Secretaria General, LIBRESE la comunicacion a que se refiere el articulo 36 del Decreto 2591 de 1991.
