- Primero. Revocar la sentencia proferida por el Juzgado Ochenta y Dos (82) Penal Municipal de Bogotá y en su lugar conceder la tutela del derecho constitucional a la salud por conexidad con el derecho fundamental a la vida digna de Ingrid Stella Díaz Ulloa.
- Segundo. Ordenar a COMPENSAR EPS que en el plazo de quince días, contados a partir de la notificación del presente fallo, adelante todos los trámites pertinentes con el fin de que en el término de un mes, haya sido practicada la intervención de corrección de estrabismo horizontal para ambos ojos bajo anestesia general, que inicialmente le había sido prescrita a Ingrid Stella Díaz por la médico tratante.
- Tercero. Por Secretaría General Remitir al Ministerio de la Protección Social y a la Superintendencia Nacional de Salud, el texto de la presente sentencia, con el fin de que se informen sobre algunos de los problemas del sistema de seguridad social en salud, relacionados con las decisiones de las empresas prestadoras de salud, acerca de las exclusiones del POS y del POSS, en los términos de esta sentencia.
- Cuarto. Por Secretaría General librar las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991.
