- Primero. Se REVOCA el fallo de 10 marzo de 1999, proferido por el Juzgado Promiscuo Municipal de Valencia, en la tutela de la referencia, y en su lugar se CONCEDE la tutela por violación al mínimo vital y al derecho a la igualdad. En consecuencia se ORDENA al Alcalde de Valencia que, si no lo ha hecho, en el término de 48 horas proceda a pagar la pensión de jubilación a Raúl Tobías Pacheco; y se lo previene para que en adelante no demore el pago de las mesadas correspondientes.
- Segundo. Para los efectos del artículo 36 del decreto 2591 de 1991, el Juzgado de origen hará las notificaciones y tomará las medidas adecuadas.
