- Primero. REVOCAR EN TODAS SUS PARTES el fallo proferido por la Juez Once Laboral del Circuito de Santa Fe de Bogotá, D.C. el ocho (8) de agosto de mil novecientos noventa y cuatro (1994), mediante el cual había negado la protección judicial que merecía EFRAIN YAZO FORERO.
- Segundo. CONCEDESE la tutela solicitada y, en consecuencia, SE ORDENA al Director de la Caja Nacional de Previsión Social que, si todavía no lo ha hecho, resuelva u ordene resolver sobre el recurso interpuesto por el accionante, a más tardar dentro de las cuarenta y ocho (48) horas siguientes a la notificación de esta providencia.
- Tercero. ADVIERTESE al Director de la Caja Nacional de Previsión Social que está obligado a tomar las medidas administrativas necesarias y a prevenir a los servidores públicos bajo su dependencia para que en esa entidad no prosiga la permanente violación del derecho fundamental de petición. Esta Sentencia se le notificará personalmente.
- Cuarto. REMITASE copia del Expediente y de esta Sentencia a la Procuraduría General de la Nación para que se investigue la conducta de los funcionarios de la Caja Nacional de Previsión que estaban encargados de resolver la petición que ha dado lugar a la tutela.
- Quinto. LIBRESE la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
