- Primero. CONFIRMASE el fallo proferido por el Tribunal Contencioso Administrativo del Cauca el 21 de octubre de 1996, que negó la protección pedida, dada la existencia de otros medios judiciales de defensa y en cuanto no fue probada la ineptitud de los mismos para lograr el amparo de derechos fundamentales.
- Segundo. PREVIENESE a la Caja de Previsión Social del Cauca en el sentido de que su negligente conducta en lo relativo al pago de prestaciones sociales a su cargo vulnera el artículo 209 de la Constitución Política y causa perjuicio a los trabajadores.
- Tercero. ADICIONASE el fallo de instancia en el sentido de ordenar que se compulsen copias de lo actuado a la Procuraduría General de la Nación para que se inicie la correspondiente investigación por faltas disciplinarias.
- Cuarto. DESE cumplimiento a lo previsto en el artículo 36 del Decreto 2591 de 1991.
