- Primero. REVOCAR la sentencia proferida por el Juzgado 15 Penal Municipal de Santiago de Cali y, en su lugar, CONCEDER la tutela incoada por Julio Enoc Varela Rojas.
- Segundo. ORDENAR al Alcalde Municipal de Santiago de Cali que, dentro del término quince (15) días contados a partir de la notificación de ésta providencia, cancele las mesadas adeudadas al demandante, advirtiéndole que también podrá hacer uso del anticipo contemplado en el parágrafo 6 del artículo 2 de la Ley 549 de 1999, para lo cual dispondrá del término de un (1) mes.
- Tercero. PREVENIR a la autoridad demandada para que se apreste a cumplir lo señalado en éste fallo, so pena de incurrir en desacato, y para que en lo sucesivo no repita la omisión que dio origen a la acción de tutela incoada.
- Cuarto. Por Secretaría, LÍBRESE la comunicación prevista en el artículo 36 del Decreto 2591 de 1991, para los fines allí contemplados.
