- en nombre del pueblo y por mandato de la Constitución,
- R E S U E L V E :
- Primero. Confirmar los fallos proferidos por el Juzgado 1º Civil del Circuito de Riohacha el 14 de abril de 1997, y por la Sala Civil y de Familia del Tribunal Superior de Riohacha el 23 de mayo del mismo año, mediante el cual se concedió la tutela formulada por el ciudadano JORGE ELIECER BALLESTEROS BERNIER contra la Contraloría Departamental de la Guajira.
- Segundo. Remítase copia de la presente providencia y de las diligencias relacionadas con este proceso a la Fiscalía General de la Nación y a la Procuraduría General de la Nación, para los efectos señalados en la parte motiva de esta sentencia.
- Tercero. Líbrense por Secretaría General las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991.
