- Primero. REVOCANSE las sentencias proferidas por el Juzgado
- Tercero. Laboral del Circuito y por la Sala Laboral del Tribunal de Distrito Judicial de Santa Marta los días 23 de febrero y 9 de abril de 1996, al resolver sobre la acción de tutela incoada por NAYIBE CADENA ROJAS a nombre de ROSA MARIA NORIEGA YACOMELO.
- Segundo. En aplicación de lo dispuesto por el artículo 38 del Decreto 2591 de 1991, DENIEGANSE las pretensiones de la demanda.
- Sin embargo, no habrá lugar a la devolución de sumas ya pagadas por concepto de mesadas pensionales.
- Tercero. COMPULSENSE copias del expediente y de esta providencia con destino a la Sala Jurisdiccional Disciplinaria del Consejo Superior de la Judicatura, para lo de su competencia en relación con la conducta de la abogada NAYIBE CADENA ROJAS.
- Cuarto. REMITANSE copias del expediente y de esta sentencia a la Directora General de Descentralización y Desarrollo Territorial del Ministerio de Salud-Fondo Nacional del Pasivo Prestacional del Sector Salud, para lo de su cargo.
- Quinto. NOTIFIQUESE personalmente a ROSA MARIA NORIEGA YACOMELO y a NAYIBE CADENA ROJAS, según lo dispuesto en el artículo 36 del Decreto 2591 de 1991.
