- en nombre del pueblo y por mandato de la Constitución,
- F A L L A :
- Primero. Revocar la sentencia del Tribunal Contencioso Administrativo de Bolívar proferida el 27 de marzo de 1992. En su lugar se ordena al señor Gobernador del Departamento de Bolivar que en un plazo de cuarenta y ocho (48) horas a partir de la notificación a él de esta sentencia, proceda a contestar la solicitud que le formuló el señor Hermógenes Martínez Mesa el 13 de enero de 1992 (fls. 34 y 35 del proceso de tutela) sobre un posible reajuste a su pensión de jubilación. Y en caso de ser procedente tal reajuste, proveer al reconocimiento y pago del mismo hasta la fecha de este fallo y de aquí en adelante.
- Segundo. Del cumplimiento de esta sentencia dará cuenta dicho Gobernador oportunamente al Presidente del Tribunal Contencioso Administrativo de Bolivar.
- Tercero. Comuníquese al mencionado Tribunal la presente decisión para que sea notificada a las partes, conforme a lo dispuesto en el artículo 36 del Decreto 2591 de 1991, con entrega a todos ellos de copia de esta sentencia.
