- en nombre del pueblo y por mandato de la Constitucion,
- R E S U E L V E :
- Primero. REVOCANSE los numerales
- primero. y
- segundo. del fallo de tutela calendado 16 de junio de 1994, proferido por el Juzgado Sesenta y Dos Penal Municipal de esta ciudad, conforme a lo expuesto en la parte motiva de esta providencia.
- Segundo. En su lugar, CONCEDASE la accion de tutela por vulneracion del derecho constitucional fundamental de peticion y, en consecuencia, se ordena a la Caja Nacional de Prevision Social de esta ciudad, que dentro del termino de cuarenta y ocho (48) horas, contadas a partir de la notificacion de esta sentencia, resuelva la solicitud de reconocimiento y sustitucion pensional presentada por el senor Dario Gutierrez Ramirez, radicada con el numero 14438 de 12 de octubre de 1993, si para la fecha de esta decision no lo ha hecho.
- Tercero. COMUNICAR el contenido de esta decision al Juez Sesenta y Dos Penal Municipal de esta ciudad, el cual notificara la sentencia de esta Corte a las partes y adoptara las decisiones necesarias para adecuar su fallo a lo dispuesto por esta, de conformidad con el articulo 36 del decreto 2591 de 1991.
