- Primero. CONFIRMAR, por las razones expuestas y con las observaciones que aquí se consignan, el fallo de fecha 29 de junio de 1994, proferido por el Juzgado
- Cuarto. Laboral del Circuito de Santa Fe de Bogotá, al resolver sobre la acción de tutela instaurada por la Asociación de Ex-empleados del Banco Popular "ASOEXBANPO".
- Segundo. ADICIONASE la Sentencia revisada en el sentido de negar la tutela en lo concerniente al Instituto de Seguros Sociales.
- Tercero. ADVIERTESE al Gobierno Nacional y al Fondo de Garantías de Instituciones Financieras -FOGAFIN- que, cuando se reanude el proceso de venta de las acciones que posee el Estado en el Banco Popular, deberán dar aplicación al artículo 60 de la Constitución Política.
- Para el efecto, se remitirá copia de esta providencia al Ministro de Hacienda y Crédito Público y al Director de FOGAFIN.
- Cuarto. Líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
