- en nombre del pueblo y por mandato de la Constitución,
- R E S U E L V E :
- PRIMERO. REVOCAR por las razones expuestas, el fallo del Tribunal Superior de Valledupar proferido el 5 de mayo de 1994, y en su lugar conceder la acción de tutela instaurada por EDGAR RINCON CASTILLA.
- SEGUNDO. CONCEDER la acción de tutela en relación con el derecho al acceso efectivo a la administración de justicia y al cumplimiento de las providencias judiciales, para cuya protección se ordenará al señor Gerente Liquidador de EMPOCESAR LTDA., para que dentro de las cuarenta y ocho (48) horas siguientes a la ejecutoria de esta providencia, proceda a hacer efectiva la orden contenida en la sentencia proferida por el Juzgado
- Segundo. Laboral del Circuito de Valledupar el 21 de octubre de 1993, en el sentido de proceder a reintegrar al señor EDGAR RINCON CASTILLA al mismo cargo y en las mismas condiciones de trabajo que obstentaba el día 30 de diciembre de 1989, cuando se le dió por terminado su contrato de trabajo, si para la fecha de notificación de este fallo aún no se ha cumplido.
- TERCERO. Por Secretaría, líbrense los oficios de que trata el artículo 36 del Decreto 2591 de 1991.
