- Primero. CONFIRMAR la sentencia del Tribunal Superior del Distrito Judicial de Santa Marta, Sala de Decisión Civil, de fecha veinte (20) de marzo de mil novecientos noventa y seis (1996), la cual confirmó el fallo del Juzgado
- Segundo. (2o.) Civil del Circuito de Santa Marta, de fecha cuatro (4) de marzo del corriente año, que, a su vez, denegó la tutela impetrada.
- Segundo. PONER EN CONOCIMIENTO de la Procuraduría Delegada para Asuntos Ambientales la construcción del Parque Acuático El Rodadero en Santa Marta, a fin de que, en defensa del medio ambiente, revise las obras, analice todo el proceso y adopte las medidas que considere necesarias. Para ello se le remitirá una fotocopia íntegra del expediente de esta tutela.
- Tercero. COMUNICAR esta providencia al Juzgado
- Segundo. (2o.) Civil del Circuito de Santa Marta, para los efectos previstos en el artículo 36 del decreto 2591 de 1991.
