Primero. CONFIRMAR la sentencia proferida el 6 de diciembre de 2001, por la Sala de Casación Penal de la Corte Suprema de Justicia, pero con base en las consideraciones aquí expuestas.
Segundo. ADVERTIR a la Tesorería Municipal del Guamo (Tolima), para que en el futuro, retenga y traslade de manera puntual los aportes sindicales con destino al sindicato de SINTRAESEMTOL, informando de ello al sindicato.
De igual forma, el propio sindicato de SINTRAESEMTOL deberá coordinar su actividad administrativa entre su sede principal y sus subsedes en los diferentes municipios del Departamento del Tolima, a fin de recaudar los recursos que constituyen aportes sindicales de sus asociados.
Tercero. Por Secretaría General, líbrese la comunicación de que trata el artículo 36 del Decreto 2591 de 1991.
