- Primero. REVOCAR la sentencia expedida por el Juzgado 5 Civil Municipal de Palmira, el 3 de diciembre de 1998.
- Segundo. TUTELAR el derecho constitucional fundamental a la vida de Luis Carlos Solarte Montenegro. En consecuencia, ordenar a la Entidad Promotora de Salud Coomeva que, dentro de las doce (12) horas siguientes a la notificación de esta providencia, lo afilie nuevamente como cotizante del plan obligatorio de salud y reanude el tratamiento de hemodiálisis con bicabornato que venía practicándosele semanalmente hasta el mes de octubre de 1998.
- Tercero. REMITIR una copia de la presente providencia con destino al Instituto de Seguros Sociales, para que proceda a suspender la afiliación que el demandante tiene como beneficiario de su cónyuge, de conformidad con el artículo 51 del decreto 806 de 1998.
- Cuarto. Líbrese por la Secretaría General de esta Corporación, la comunicación de que trata el artículo 36 del decreto 2591 de 1991.
