  1. Primero. REVOCAR el fallo del Juzgado
  2. Segundo. Civil Municipal de Santa Marta, al resolver sobre la acción de tutela incoada por Eduardo Sánchez Cuello contra el Gobernador del Departamento del Magdalena y el Fondo de Pensiones Territoriales del mismo Departamento.
  3. Segundo. CONCEDER la tutela, ordenando a los demandados que procedan a cancelar las mesadas adeudadas al actor, a más tardar dentro de las cuarenta y ocho (48) horas siguientes a la notificación de este Fallo.
  4. Dicho pago debe hacerse con cargo al anticipo contemplado en el parágrafo 6 del artículo 2 de la Ley 549 de 1999.
  5. Tercero. PREVENIR al Gobernador del Magdalena para que evite incurrir en dilaciones en el pago de las mesadas pensionales de sus ex trabajadores.
  6. Cuarto. Por Secretaria, LÍBRESE la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
