- R E S U E L V E:
- PRIMERO. CONFIRMAR la sentencia de tutela del 6 de abril de 1995, proferida por el Consejo de Estado, Sala de lo Contencioso Administrativo, Sección Tercera.
- SEGUNDO. CONDENAR al demandante, ERNESTO BERNAL MENDEZ, al pago de costas como consecuencia del ejercicio temerario de la acción de tutela.
- TERCERO. ORDENAR al Tribunal Administrativo de Cundinamarca, Sección Segunda, Subsección "B", tribunal de primera instancia en el presente proceso de tutela, se sirva tasar las costas que debe cancelar el peticionario, de conformidad con lo dispuesto en el numeral
- segundo. de esta providencia.
- CUARTO. LIBRESE comunicación al mencionado Tribunal, con miras a que se surta la notificación de esta providencia, según lo establecido en el artículo 36 del Decreto 2591 de 1991.
