- en nombre del Pueblo y por mandato de la Constitución,
- R E S U E L V E :
- Primero. Confirmar las sentencias proferidas por el Juzgado
- Séptimo. Penal Municipal de noviembre 28 de 1993, y por el Juzgado
- Cuarto. Penal del Circuito de Buenaventura, el día 7 de febrero de 1994 dentro de la acción de tutela de la referencia.
- Segundo. Advertir al rector del Colegio Pascual de Andagoya, que debe establecer un procedimiento que justifique, en casos excepcionales, la exoneración de llevar el uniforme, con lo cual se busca una solución razonable para el caso de los estudiantes que cumplen también tareas laborales, y con el fin de dejar a salvo el derecho fundamental a la educación, que se ha analizado en este caso.
- Tercero. Comunicar la presente decisión conforme se ordena en el artículo 36 del Decreto 2591 de 1991.
