- PRIMERO. REVOCAR la sentencia proferida por el Juzgado Once Penal del Circuito de Santafé de Bogotá, D.C., por las razones expuestas en esta sentencia.
- SEGUNDO. CONCEDER la tutela del derecho de petición de la señora Blanca Lelis Rodríguez Romero, ordenando al Fondo Prestacional del Magisterio y a la Fiduciaria la Previsora, que en el término de cuarenta y ocho (48) horas, contado a partir de la notificación, den respuesta a la solicitud de pago de cesantías parciales, presentada por la actora, tal como se indico en la parte motiva de esta sentencia.
- TERCERO. COMUNICAR, por intermedio de la Secretaria General de la Corte Constitucional, el contenido de la sentencia al Juzgado Quince Penal Municipal de Santafé de Bogotá D.C., para que sean notificadas las partes, de conformidad con lo dispuesto en el artículo 36 del decreto 2591 de 1991.
