  1. PRIMERO. REVOCAR la sentencia proferida por el Juzgado
  2. Segundo. Penal Municipal de Santa Fe de Bogota el diez (10) de febrero de 1995 en cuanto nego la tutela de los derechos de la accionante, y en su lugar CONCEDER la proteccion de los derechos de la accionante. En consecuencia, se ordena a la CAJA NACIONAL DE PREVISION SOCIAL incluir en la nomina de pensionados para pago hacia el futuro de las mesadas pensionales a la senora ROSA DILMA HEREDIA DE RINCON, identificada con cedula de ciudadania No. 20"313.463, de conformidad con el reconocimiento que la entidad efectuo mediante las resoluciones Nos. 6211 y 5268 de 1993.
  3. Para hacer la inclusion en nomina, la CAJA NACIONAL DE PREVISION SOCIAL dispondra del termino de 48 horas, contadas a partir de la notificacion de la presente providencia.
  4. SEGUNDO. NIEGANSE las demas solicitudes de la demanda.
  5. TERCERO. LIBRENSE por Secretaria las comunicaciones de que trata el articulo 36 del Decreto 2591 de 1991, para los efectos alli contemplados.
