- Primero. REVOCAR los fallos proferidos por el Juzgado 4 Penal del Circuito de Santiago de Cali y por la Sala Penal del Tribunal Superior de la misma ciudad, mediante los cuales se negó la protección solicitada. En su lugar, se concede la tutela del derecho al trabajo en condiciones dignas y justas.
- En consecuencia, se ORDENA que, dentro de las cuarenta y ocho (48) horas siguientes a la notificación del presente fallo, si no lo hubiere hecho ya, proceda a cancelar la totalidad de las sumas adeudadas al demandante.
- Segundo. DESE cumplimiento a lo previsto en el artículo 36 del Decreto 2591 de 1991.
