  1. PRIMERO. REVOCAR el ordinal
  2. primero. de la sentencia de enero tres (3) de mil novecientos noventa y cuatro (1994), proferida por el Juzgado Ochenta y Cuatro Penal Municipal de Santafe de Bogota D.C, y en su lugar, TUTELAR el derecho fundamental a la salud de los habitantes del edificio "Andalucia" del Barrio "Condado de Castilla", ubicado en la diagonal 6A No 77-51.
  3. SEGUNDO. MODIFICAR el ordinal
  4. segundo. de la parte resolutiva de la sentencia del Juzgado Ochenta y Cuatro Penal Municipal, en el sentido de ordenar compulsar copias con destino a la Personeria Distrital, con el fin de que se investiguen las presuntas irregularidades en que esten incurriendo los funcionarios encargados de las obligaciones de Control y Vigilancia, de que trata el Decreto 1421 de 1993 (Estatuto de Bogota).
  5. TERCERO. PREVENIR al senor Alcalde Mayor de Santafe de Bogota D.C., para que en ningun caso se vuelva a incurrir en las omisiones que dieron merito para conceder la presente accion de tutela, y que, si procediere de modo contrario, sera sancionado de acuerdo con lo previsto en el decreto 2591 de 1991.
  6. CUARTO. ENVIAR copia de esta providencia al senor Gerente de la Empresa Distrital de Servicios Publicos EDIS, para los consiguientes fines.
  7. QUINTO. LIBRAR comunicacion al Juzgado Ochenta y Cuatro Penal Municipal de Santafe de Bogota D.C., para que de conformidad con lo dispuesto por el articulo 36 del decreto 2591 de 1991, notifique esta sentencia a las partes y adopte las decisiones necesarias para adecuar su fallo a lo dispuesto por esta Sala.
