Primero. CONFIRMAR, pero por las razones expuestas en esta providencia, el fallo proferido el veintisiete (27) de agosto del 2002 por el Juzgado
Primero. Civil del Circuito de Sincelejo, mediante el cual fue negado el amparo solicitado por la señora Marlyn Vieira Mercado.
Segundo. ORDENAR que por la Secretaría de la Corte Constitucional se envíe copia de la presente sentencia a la Procuraduría Regional del Departamento de Sucre, para que se inicie la investigación disciplinaria destinada a establecer la responsabilidad por la omisión de los agentes municipales de Toluviejo - Sucre -, que se abstuvieron de transferir a COLFONDOS S.A. las sumas de dinero descontadas al señor Jorge Luis Ruiz Alvarez. La Procuraduría Regional del Departamento de Sucre deberá verificar si el Municipio de Toluviejo - Sucre -, ha reconocido y pagado las mesadas pensionales que jurídicamente correspondan a la señora Marlyn Vieira Mercado; una vez verificado el pago de las sumas de dinero adeudadas a la accionante, la Procuraduría Regional informará al Juzgado Promiscuo Municipal de Toluviejo - Sucre -, para que éste Despacho verifique el cumplimiento de la obligación a cargo del Municipio.
Tercero. LÍBRESE por Secretaría la comunicación de que trata el artículo 36 del Decreto 2591 de 1991.
