- R E S U E L V E :
- PRIMERO. REVOCAR el fallo proferido por el Juzgado
- Segundo. Civil Municipal de Ibagué, el 21de noviembre de 1994.
- SEGUNDO. CONCEDER la tutela del derecho a la seguridad social de la accionante y de su cónyuge, y en consecuencia, ORDENAR al señor Gerente de la Seccional Tolima del Instituto de los Seguros Sociales, para que dentro de las cuarenta y ocho (48) horas siguientes a la notificación de la presente providencia, proceda a decidir de conformidad con los artículos 48 de la Constitución Política y 163 de la Ley 100 de 1993, acerca de la inscripción del señor GERMAN GARIBELLO TRIANA, en su calidad de cónyuge de la afiliada, como posible beneficiario de los servicios que presta esa entidad, y en particular, en cuanto hace a la cobertura familiar comprendida dentro del Plan Obligatorio de Salud.
- TERCERO. Por la Secretaría General de la Corte Constitucional, líbrense las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
