- Primero. REVOCAR el fallo del Consejo de Estado, Sala de lo Contencioso Administrativo, Sección Primera, del tres (3) de julio de mil novecientos noventa y ocho (1998), proferido al resolver sobre la acción de tutela incoada por JACKELINE RODRIGUEZ RUIZ, contra el Municipio de Ibagué, y, en consecuencia, conceder la protección solicitada.
- Segundo. ORDENAR al Municipio de Ibagué que, en el término de cuarenta y ocho (48) horas siguientes a la notificación de la presente providencia, proceda a designar en propiedad a JACKELINE RODRIGUEZ RUIZ en el cargo de docente en la vereda "Las Pavas", para el cual concursó obteniendo el primer lugar.
- Tercero. Quien actualmente ocupa el cargo, DIANA ROCIO MACANA SOLER, desplazada del mismo en virtud de esta Sentencia, deberá ser nombrada de manera inmediata cuando se produzca una nueva vacante, ya que obtuvo el
- segundo. lugar en el concurso.
- Cuarto. El desacato a lo ordenado en esta providencia se sancionará en la forma prevista en el artículo 52 del Decreto 2591 de 1991.
- Quinto. Por Secretaría líbrese la comunicación de que trata el artículo 36 del Decreto 2591 de 1991.
