PRIMERO. CONFIRMAR la Sentencia de primera instancia en cuanto tuteló los derechos fundamentales a la vida, la integridad personal y el derecho a tener una familia, pero REVOCAR en cuanto la concedió como mecanismo transitorio y en su lugar se otorga de manera definitiva.
SEGUNDO. CONFIRMAR los numerales 2º y 4º, en cuanto le ordenan y previenen a Ramiro Hernández Rueda para que se abstenga de realizar todo acto violento contra su compañera permanente y sus hijas.
TERCERO. ADICIONAR el numeral 3º en el sentido de ordenarle a las autoridades de Policía del Barrio Nueva España de Santafé de Bogotá, tanto al Alcalde Local como al Comandante de Policía respectivos, que tomen las medidas de protección inmediatas y urgentes cuando reciban información de que Cruz María Sotelo Castillo o sus hijas menores Adriana, Katherin y Alejandra Hernández Sotelo sean amenazadas por Ramiro Hernández o sean retiradas por él del hogar que habitan.
CUARTO. El incumplimiento por parte de Ramiro Hernández Rueda de la obligación de no lanzar a la calle a su compañera o hijas, o de atentar contra la vida e integridad personal de ellas, será sancionada por el Juez de Tutela, previo incidente de desacato, con arresto de hasta seis meses, sin perjuicio de las sanciones penales a que hubieren lugar.
QUINTO. Comisionar al Juez de primera instancia para que notifique la Sentencia a las partes y adopte las decisiones necesarias señaladas en el art. 36 del Decreto 2591 de 1991.
SEXTO. Envíese copia del fallo al Defensor del Pueblo, al Alcalde Mayor de Santafé de Bogotá, al Comando de Policía de esta ciudad.
