Primero. REVOCAR, por las razones expuestas en la parte motiva de esta providencia, los fallos proferidos en segunda instancia por la Sala Laboral del Tribunal Superior de Medellín (Expediente T-244613) y por el Juzgado 23 Penal del Circuito de Medellín (Expediente T-252896), mediante los cuales se negó el amparo invocado.
En su lugar, readquieren fuerza y vigor las sentencias de primera instancia, proferidas por los juzgados
Segundo. Laboral del Circuito de Medellín y
Noveno. Penal Municipal de Medellín, los cuales SE CONFIRMAN.
Las providencias judiciales en mención deben comenzar a ser cumplidas por la empresa demandada dentro de las veinticuatro (24) horas siguientes a la notificación del presente fallo de revisión.
Se previene a la empresa demandada para que no vuelva a incurrir en conductas que puedan afectar el derecho de asociación sindical.
Segundo. Dar cumplimiento a lo dispuesto en el artículo 36 del Decreto 2591 de 1991.
