Primero. REVOCAR el fallo proferido por la Sala Laboral de la H. Corte Suprema de Justicia, de fecha junio 7 de 2000, que a su vez revocó la sentencia de fecha 16 de mayo de 2000, expedida por el Tribunal Superior de Santa Marta, dentro de la acción de tutela interpuesta por Margarita Osorio Pedrozo contra la EPS del ISS- Seccional Magdalena.
Segundo. CONCEDER la tutela del derecho a la vida en conexión con el derecho a la salud y a la seguridad social. En consecuencia se ordena al ISS-Seccional Magdalena, que en el término de cuarenta y ocho (48) horas contadas a partir de la notificación de esta providencia, si así lo estima pertinente, el médico, en la oportunidad que él indique bajo su responsabilidad profesional, practique la cirugía que requiere Margarita Osorio Pedrozo.
Tercero. DISPONER que la EPS del ISS, pueda acudir al FOSYGA para repetir por el equivalente al número de semanas faltantes, sin que la operación pueda ser supeditada a pago alguno por parte de la actora Margarita Osorio Pedrozo.
Cuarto. Por Secretaria general, líbrense las comunicaciones previstas en el artículo 36 del decreto 2591 de 1991, para los efectos allí contemplados.
