- PRIMERO. REVOCAR la Sentencia proferida por el Tribunal Superior del Distrito Judicial de Cali, Sala Penal el 21 de noviembre de 1994, y en su lugar CONFIRMAR el fallo dictado por el Juzgado
- Séptimo. Penal del Circuito de Cali el 24 de octubre de 1994 en cuanto ordenó la tutela de los derechos a la seguridad social, a la salud y a la vida de la accionante y de su hijo, y dispuso que el INSTITUTO DE SEGUROS SOCIALES -Seccional Valle- suministrara toda la atención médica, hospitalaria y farmaceútica para la madre y su hijo, por el tiempo necesario. No se ordenará el reembolso de los gastos asumidos por la accionante con ocasión del embarazo y nacimiento de su hijo por las razones expuestas en la parte motiva, a menos que para la fecha de notificación de esta providencia la demandada hubiere efectuado tal pago.
- SEGUNDO. Líbrense por Secretaría las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos contemplados en esa norma.
